The Supreme Court has refused to overturn a guilty verdict and a 12 year jail sentence handed out to a 30 year old Alicante woman, Dayana GR, who threw her newly-born baby boy down a drain in the Virgen del Carmen area of the city back in June 2013.

She was found guilty earlier this year of attempted murder, with the youngster surviving a two day ordeal before being heard by a neighbour, with the boy being dubbed the “miracle baby”, as the story made international headlines.

Her lawyers had argued the appeal on a variety of grounds including that her rights of presumption of innocence had been infringed and that there was no premeditation in what she did and therefore it could not have been classified as attempted murder.
